Terms of Service

1. About Wilderness

Wilderness Incorporated is a Delaware corporation that develops and operates consumer software products.

Our current products include:

• Agentic Blue, an agentic social network;
• Jungle, a paid social network;
• Dinnertime, a dinner planning and reservation-coordination application; and
• Image Send, an end-to-end encrypted image sending application.

2. Eligibility

You must be at least 13 years old to use the Services.

By using a Service, you represent that:

• you are at least 13 years old;
• you have the legal capacity to agree to these Terms;
• the information you provide to Wilderness is accurate; and
• your use of the Services does not violate applicable law.

If you are under the age of majority where you live, your parent or legal guardian may be required to consent to your use of certain Services or transactions.

The Services are currently intended for users in the United States.

3. Accounts

Certain features require you to create an account.

You are responsible for maintaining the confidentiality and security of your account and authentication credentials.

You agree to:

• provide accurate account information;
• keep your account information reasonably current;
• use only accounts you are authorized to use;
• take reasonable steps to prevent unauthorized access to your account; and
• promptly notify Wilderness if you believe your account has been compromised.

You may not impersonate another person or create an account using information that you do not have permission to use.

You are responsible for activity conducted through your account, except to the extent that activity results from circumstances for which you are not legally responsible.

4. License to Use the Services

Subject to these Terms, Wilderness grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for their intended purposes.

You may not, except where applicable law prohibits such a restriction:

• copy, modify, or distribute Wilderness software;
• reverse engineer, decompile, or attempt to derive source code from the Services;
• circumvent security, authentication, access controls, payment systems, or technical restrictions;
• scrape or automatically extract data from the Services without our permission;
• interfere with the proper operation of the Services;
• use the Services to develop a substantially competing service through unauthorized access to Wilderness systems or proprietary information;
• resell access to the Services without our permission; or
• use Wilderness trademarks, branding, designs, or copyrighted materials except as permitted by law or with our permission.

All rights not expressly granted to you are reserved by Wilderness and its licensors.

5. User Content

Certain Services allow users to create, upload, send, or publish content.

“User Content” may include:

• text;
• links;
• posts;
• replies;
• comments;
• introduction videos;
• dinner photographs;
• encrypted images; and
• other materials submitted through the Services.

You retain ownership of your User Content.

License to Wilderness

When you submit User Content to a Service, you grant Wilderness a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that User Content only as reasonably necessary to operate, provide, secure, and improve the applicable Service and to perform functions you request.

For example:

• Jungle must store and display an introduction video to authenticated Jungle users;
• Dinnertime must store dinner photos and display them to eligible dinner participants;
• Agentic Blue must transmit a published post to an AI provider when AI processing is requested or is part of the applicable feature; and
• Image Send must store and transmit encrypted image data without decrypting the underlying image.

This license ends when the User Content is deleted from the Services, except to the limited extent technically necessary to complete an initiated deletion process or as otherwise required by applicable law.

Nothing in these Terms gives Wilderness ownership of your User Content.

6. Your Responsibility for User Content

You represent and warrant that you have all rights necessary to submit User Content to the Services.

You may not upload, publish, transmit, or otherwise use the Services for content that:

• infringes copyrights, trademarks, privacy rights, publicity rights, or other rights of another person;
• is unlawful;
• contains sexual exploitation or sexual abuse material involving minors;
• promotes or facilitates terrorism or violent extremism;
• contains credible threats of violence;
• is intended to harass, intimidate, stalk, or seriously abuse another person;
• contains malware or malicious code;
• facilitates fraud, phishing, identity theft, or other deceptive activity;
• violates another person's privacy;
• contains nonconsensual intimate imagery;
• is designed to interfere with or damage Wilderness infrastructure; or
• otherwise violates applicable law.

Wilderness may remove or restrict content that violates these Terms.

7. Social Services and Community Conduct

Agentic Blue and Jungle contain social or user-generated content features.

Users are expected to interact with others in a lawful and respectful manner.

You may not use the Services to:

• threaten or harass another person;
• repeatedly target another person with unwanted communications;
• impersonate another user;
• fraudulently manipulate engagement;
• distribute spam;
• publish another person's sensitive personal information without authorization;
• encourage illegal conduct; or
• abuse reporting, moderation, or blocking systems.

Wilderness may provide tools that allow users to report content or users and block other users.

We may investigate reports and take appropriate actions, including removing content, restricting features, suspending accounts, or terminating accounts.

8. Agentic Blue

Agentic Blue allows users to publish text and links and provides artificial intelligence features.

AI Processing

Agentic Blue uses artificial intelligence provided by third parties, including OpenAI, to process certain content.

When you publish or submit content for AI processing, you authorize Wilderness to transmit the applicable content to the AI service provider for the purpose of providing the requested functionality.

Agentic Blue does not send unpublished drafts to OpenAI solely because you are composing them.

Wilderness does not train its own artificial intelligence models using Agentic Blue user content.

AI Output

Artificial intelligence may produce inaccurate, incomplete, offensive, or otherwise unsuitable results.

AI output should not be relied upon as professional legal, medical, financial, investment, safety, or other professional advice.

You are responsible for reviewing AI-generated or AI-modified content before relying on, publishing, or acting upon it.

Wilderness does not guarantee the accuracy, completeness, originality, or suitability of AI-generated results.

No Direct Messaging

Agentic Blue currently does not provide private direct messaging between users.

9. Jungle

Jungle is a social network available to authenticated users.

Jungle users may:

• upload introduction videos;
• publish text posts; and
• publish text replies.

Introduction videos are intended to be accessible only to authenticated Jungle users.

Jungle does not currently provide private direct messaging.

Certain Jungle functionality may require payment.

You agree not to attempt to bypass payment requirements or gain unauthorized access to paid functionality.

10. Dinnertime

Dinnertime helps users organize dinners, coordinate plans, collect RSVPs, select restaurants, facilitate reservations, communicate service information, and share photographs.

Dinner Plans

Dinnertime provides tools that help users coordinate with other people.

Wilderness does not guarantee that:

• invited users will attend;
• votes or RSVPs will be accurate;
• another participant will behave appropriately;
• a dinner will occur as planned; or
• a restaurant will honor a reservation request.

Users are responsible for their own decisions regarding attendance and participation in in-person events.

Restaurant Reservations

Dinnertime may contact restaurants on behalf of users to request reservations.

By asking Dinnertime to facilitate a reservation, you authorize Wilderness and its service providers to communicate relevant reservation information to the restaurant.

This information may include:

• your name;
• your phone number;
• requested date and time;
• party size; and
• other information reasonably necessary to request or manage the reservation.

Restaurants Are Independent Businesses

Restaurants are independent third parties and are not controlled by Wilderness.

Wilderness does not guarantee:

• restaurant availability;
• reservation acceptance;
• restaurant operating hours;
• pricing;
• menu availability;
• food quality;
• food safety;
• accessibility;
• service quality; or
• the accuracy of information supplied by a restaurant or third-party provider.

A reservation is not guaranteed until it has been accepted or confirmed by the applicable restaurant.

Wilderness is not responsible for restaurant cancellations, changes, closures, overbooking, or other actions taken by a restaurant.

Calls and SMS

Dinnertime may use telecommunications providers such as Twilio to:

• call restaurants regarding reservations; and
• send transactional SMS notifications.

By providing your phone number and requesting features requiring SMS communication, you authorize us to send service-related messages associated with those features.

Message and data rates charged by your carrier may apply.

Dinnertime communications are not intended for emergency services.

Dinner Photos

Photos associated with a Dinnertime may be visible to users who RSVP'd for that Dinnertime.

You should not upload a photograph unless you have the legal right to upload and share it.

You are responsible for considering the privacy of people appearing in photographs you upload.

11. Image Send

Image Send allows users to transmit end-to-end encrypted images.

Encryption

Images transmitted through Image Send are encrypted on the sender's device before being uploaded.

Wilderness does not possess the encryption keys required to decrypt the underlying image content.

Accordingly, Wilderness cannot ordinarily view or recover the contents of images protected by Image Send's end-to-end encryption.

Metadata

End-to-end encryption of image content does not mean that all information associated with a transmission is encrypted.

Wilderness may process metadata necessary to operate Image Send, including information such as:

• sender;
• recipient;
• timestamp;
• IP address;
• file size; and
• delivery or technical information.

Recipient Behavior

Image Send does not provide recipients with an in-app feature for downloading or saving received images.

However, Wilderness cannot guarantee that a recipient will be technically unable to preserve an image by other means, including screenshots, photography of a device screen, modified devices, operating-system functionality, or other methods outside Wilderness's control.

You should therefore send images only to people you trust.

Lost Keys and Content Recovery

Because Wilderness does not possess your encryption keys, certain encrypted content may be unrecoverable if required cryptographic information is lost.

Wilderness does not guarantee that encrypted images can be recovered in every circumstance.

12. Payments and Paid Features

Some Wilderness Services or features require payment.

Payments may be processed through:

• Apple In-App Purchase and StoreKit; or
• Adyen.

Prices will be displayed before purchase.

By purchasing a paid feature, you authorize the applicable payment provider to charge the displayed amount and applicable taxes.

Payment processing may also be subject to the payment provider's terms.

Apple Purchases

Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable payment, billing, refund, and App Store terms.

Unless otherwise required by applicable law, Wilderness cannot directly issue refunds for transactions controlled exclusively by Apple where Apple retains authority over the transaction.

Web Purchases

Web purchases processed through Adyen may be subject to additional payment processing requirements.

Price Changes

Wilderness may change prices for future purchases.

A price change does not retroactively increase the price of a purchase you already completed.

13. Third-Party Services

The Services may rely on or interact with third parties, including:

• Amazon Web Services;
• Vercel;
• Apple;
• Google;
• OpenAI;
• Twilio;
• Adyen;
• restaurants; and
• websites linked by users.

Third-party products and services may be governed by their own terms and policies.

Wilderness is not responsible for third-party services that it does not control.

Your use of third-party services must comply with applicable third-party terms.

14. Intellectual Property

Except for User Content and third-party materials, the Services and their contents are owned by Wilderness or its licensors.

This includes Wilderness software, interfaces, designs, logos, graphics, text, branding, trademarks, product names, and other proprietary materials.

Wilderness, Agentic Blue, Jungle, Dinnertime, Image Send, and related branding may be protected by trademark, copyright, or other intellectual property laws.

These Terms do not grant you permission to use Wilderness branding in a manner that suggests sponsorship, endorsement, affiliation, or authorization where none exists.

15. Copyright Complaints

Wilderness respects intellectual property rights.

If you believe content available through a Wilderness Service infringes your copyright, you may contact us with information sufficient for us to evaluate the complaint.

Your notice should identify the copyrighted work, the allegedly infringing material, your contact information, and any other information reasonably necessary to evaluate your claim.

Wilderness may remove allegedly infringing content and may restrict or terminate users who repeatedly infringe intellectual property rights.

16. Privacy

Our collection and use of personal information are described in the Wilderness Privacy Policy, available at:

By using the Services, you acknowledge that your information will be handled as described in that policy.

17. Suspension and Termination

You may stop using the Services at any time.

You may request deletion of your account and associated information by contacting:

Wilderness may suspend, restrict, or terminate access to some or all of the Services if we reasonably determine that:

• you materially violated these Terms;
• your activity presents a security risk;
• your activity threatens another person;
• your activity creates legal exposure for Wilderness;
• your account is being used fraudulently;
• suspension is required by law; or
• continued access would materially threaten the integrity of the Services.

Where appropriate, we may provide notice before termination. Serious violations may result in immediate action.

Upon termination, your license to use the Services ends.

Sections that by their nature should survive termination will continue to apply, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Service Availability and Changes

We continuously develop our products.

We may:

• add or remove features;
• modify interfaces;
• discontinue functionality;
• impose or modify technical limitations;
• modify paid offerings; or
• discontinue a Service.

We do not guarantee that any Service or feature will always remain available.

Where reasonably appropriate, we may provide notice of significant changes.

19. Beta and Experimental Features

Some Wilderness features may be labeled beta, preview, experimental, or otherwise under development.

Such features may:

• contain errors;
• change substantially;
• produce unexpected results;
• experience interruptions; or
• be discontinued.

You use experimental features with the understanding that they may be less reliable than generally released functionality.

20. No Professional Advice

The Services are consumer software tools.

Nothing provided through Wilderness constitutes legal, medical, investment, financial, tax, psychological, dietary, or other licensed professional advice.

You should consult an appropriate professional when professional advice is required.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WILDERNESS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WILDERNESS DOES NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED;
• THE SERVICES WILL BE ERROR-FREE;
• ALL DATA WILL ALWAYS BE AVAILABLE;
• SECURITY SYSTEMS WILL NEVER BE COMPROMISED;
• AI OUTPUT WILL BE ACCURATE;
• RESTAURANT RESERVATIONS WILL BE SUCCESSFUL;
• USERS WILL BEHAVE APPROPRIATELY; OR
• THE SERVICES WILL MEET EVERY USER'S REQUIREMENTS.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILDERNESS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICES.

THIS INCLUDES, WHERE PERMITTED BY LAW, DAMAGES ARISING FROM:

• LOSS OF DATA;
• LOSS OF PROFITS;
• LOSS OF BUSINESS;
• INTERRUPTION OF SERVICE;
• USER CONTENT;
• ACTIONS OF OTHER USERS;
• RESTAURANT ACTIONS OR OMISSIONS;
• AI-GENERATED CONTENT;
• UNAUTHORIZED PRESERVATION OF AN IMAGE BY AN IMAGE SEND RECIPIENT; OR
• THIRD-PARTY SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDERNESS'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID WILDERNESS FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100.

Nothing in these Terms limits liability that cannot legally be excluded or limited.

23. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Wilderness Incorporated and its officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from:

• your User Content;
• your unlawful use of the Services;
• your material violation of these Terms; or
• your infringement or violation of another person's rights.

This obligation does not apply to the extent a claim results from Wilderness's own unlawful conduct.

24. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Nothing in this section deprives you of any consumer protection rights that cannot legally be waived under applicable law.

25. Disputes and Venue

Unless applicable law requires otherwise, disputes arising from these Terms or the Services that cannot be resolved informally will be brought in a state or federal court having appropriate jurisdiction in Delaware.

You and Wilderness consent to the personal jurisdiction of those courts.

Before initiating formal litigation, you are encouraged to contact Wilderness so that we may attempt to resolve the dispute informally.

26. Changes to These Terms

We may update these Terms from time to time.

If we make changes, we will update the effective date at the top of the Terms.

For material changes, we may provide additional notice through the applicable Service or another reasonable method.

If applicable law requires affirmative consent to a change, we will request it.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

27. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

The unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

28. No Waiver

If Wilderness does not enforce a provision of these Terms on one occasion, that does not waive our right to enforce that provision later.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms without Wilderness's consent.

Wilderness may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, or similar transaction.

30. Entire Agreement

These Terms, together with the Wilderness Privacy Policy and any additional terms presented for a particular Service or purchase, constitute the agreement between you and Wilderness relating to your use of the Services.

31. Terms Applicable to Apple Applications

If you download or use a Wilderness application through Apple's App Store, the following additional terms apply.

These Terms are between you and Wilderness Incorporated, not Apple. Wilderness, not Apple, is responsible for the Wilderness application and its content.

Wilderness grants you a non-transferable license to use the applicable application on Apple-branded products that you own or control and as permitted by the applicable Apple Media Services Usage Rules, including any permitted Family Sharing or volume-purchasing use.

Wilderness is responsible for providing maintenance and support for the application to the extent required by these Terms or applicable law. Apple has no obligation to provide maintenance or support services for the application.

To the extent any warranty exists under applicable law that cannot be disclaimed, Wilderness is responsible for that warranty. Apple has no other warranty obligation with respect to the application.

Wilderness, not Apple, is responsible for addressing claims relating to the application, including applicable product-liability claims, legal or regulatory claims, and consumer-protection claims.

Wilderness, not Apple, is responsible for investigating, defending, settling, and discharging claims that a Wilderness application infringes a third party's intellectual property rights.

You represent that:

• you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country; and
• you are not listed on a U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party agreements when using the application.

Apple and its subsidiaries are third-party beneficiaries of this section and, upon your acceptance of these Terms, Apple will have the right to enforce this section against you as a third-party beneficiary.
